OPSI - UNENACTED working proposal v308 | 2026-10-28T08:15:44+00:00 | Corpus 85 DRAFT TRANSITIONAL REGULATION REGULATION RESPECTING INITIAL ADMISSION, RECOGNITION OF EXPERIENCE AND TRANSITIONAL MEMBERSHIP I - PURPOSE Section 1 | ART_M485Y1EV6BLWCWCP | Version 3 This transitional regulation is made by the board of directors under section 59 of the Act, examined by the Office and approved by the Government under section 95 of the Professional Code, subject to initial adoption under section 57 of the Act. This Regulation applies to persons who carried out relevant activities before implementation of the new professional regime. Section 2 | ART_4ZQ2PRRY8XL8F4MT | Version 2 It allows: 1° direct admission where competence is sufficiently demonstrated; 2° conditional admission; 3° registration as an intern; 4° recognition of prior learning; 5° admission as a transitional member, with the single permit, entry on the roll and practice limitations. II - APPLICATION Section 3 | ART_79NURV28PPBJMBQ1 | Version 2 The Order determines and publishes the initial period for receiving applications. That period may be extended where justified by transition needs, the availability of training programs or protection of the public. Initial admission may begin as soon as the Order is legally able to process applications; it does not await documentary operation of the central registry. Section 4 | ART_SPB5S8YC10UY6V84 | Version 2 An applicant may provide, in particular: 1° diplomas; 2° qualification cards or certificates; 3° training attestations; 4° employment history; 5° professional achievements; 6° representative reports; 7° references; 8° a description of the systems and activities the applicant has mastered; 9° any other relevant evidence. Section 5 | ART_M4M8DJ3342FN9C1D | Version 4 During the initial implementation period, the Order recognizes, in particular, the following as preferred foundations for assessment: 1° a recognized diploma in fire prevention or fire safety; 2° the Diploma of Vocational Studies in Fire Protection Mechanics (5312); 3° the recognized complete professional qualification for trade 416 — fire-protection mechanic — with or without the diploma referred to in paragraph 2°; 4° a recognized fire-alarm pathway, including the CFAA-accredited pathway offered by Cégep du Vieux Montréal; 5° the Diploma of Vocational Studies in Electricity (5295), the Diploma of Vocational Studies in Installation and Maintenance of Security Systems (5296), or a valid competency certificate issued by the Commission de la construction du Québec in the electrician trade or a relevant security-systems specialty; 6° relevant university education; 7° significant professional practice in the activities concerned; 8° any relevant combination of education, qualification, certification and experience. A person who meets one of these criteria is not required to demonstrate that the person also meets the others. The Order then assesses any common professional competencies that may still be missing. III - ASSESSMENT Section 6 | ART_RFXU61VXN3TKXTT7 | Version 2 The Order assesses, in particular: 1° the duration and relevance of the experience; 2° the complexity of the activities carried out; 3° previous autonomy; 4° knowledge of technical requirements; 5° the ability to draft and interpret reports; 6° understanding of professional limits; 7° knowledge of the declaration regime; 8° ethics. Section 7 | ART_91T9ZLD4NREKW8A8 | Version 2 The Order may require: 1° an interview; 2° an examination; 3° a practical demonstration; 4° an internship period; 5° supplementary training; 6° a portfolio of work. IV - POSSIBLE DECISIONS Section 8 | ART_TT8UGCC72J1SPXYU | Version 2 The Order may: 1° issue the permit; 2° issue the permit with temporary supervised-practice status; 3° register the applicant as an intern; 4° prescribe a supplementary program; 5° admit the applicant as a transitional member holding the single permit and limited practice rights; 6° refuse the application. Section 9 | ART_1MVV7E4YQ5HJCN9Y | Version 2 A person admitted on the basis of experience receives the same single permit as any other member. Once the admission requirements have been met, no permanent category of “member admitted by experience” is created. V - TRANSITIONAL MEMBERSHIP Section 10 | ART_ZM6WUAFJN93DESUH | Version 2 The decision admitting a transitional member and the entry on the roll specify: 1° the activities authorized; 2° the systems concerned; 3° the restrictions; 4° the supervision requirements; 5° the training or internships to be completed; 6° the validity and reassessment dates, without imposing an automatic maximum duration on maintaining the status. Within those recorded limits, the transitional member may practise independently and sign expressly authorized acts. Admission does not certify competence beyond those limits and does not automatically authorize reserved approvals or attestations requiring specific authorization. Section 11 | ART_3CJ2C5CUAMGSHVY2 | Version 2 Transitional membership may be maintained or renewed by decision of the Order following reassessment where the person: 1° demonstrates continued competence for the authorized activities; 2° complies with their obligations; 3° satisfies any expressly prescribed training, assessment or supervision requirements, where applicable; 4° does not present a risk incompatible with protection of the public. No automatic maximum duration limits renewal of this status. Progression to regular membership depends on demonstrated competencies and admission conditions. A reasoned refusal of progression does not by itself prevent continued limited practice where the conditions remain satisfied, subject to applicable remedies. The registry’s minimum 24-month period is not a cap on maintenance or renewal of transitional status, which remains governed by competency and admission rules. Section 12 | ART_61FP79KQQURKXXL1 | Version 2 The mere passage of a period of 24 or 25 months does not terminate the right to continue a training program or internship. Where the reasonably required program of study or pathway exceeds that period, transitional membership, where granted, may be maintained or renewed under this regulation without an automatic maximum duration; an intern pathway remains governed by its own supervision rules. Section 13 | ART_0TGZXFQ6PAQTE5GB | Version 2 Each renewal is subject to reassessment. Subject to applicable statutory and regulatory conditions, the Order may maintain or modify limitations, impose further restrictions, suspend, decline to renew, or withdraw the status. Its decision must state reasons and remains subject to applicable remedies. VI - TEMPORARY CONTINUATION OF ACTIVITIES Section 14 | ART_H279EZ5FV8WQMLE1 | Version 2 Filing an application for admission or having it under review does not, by itself, confer any right to perform an act reserved to the Order independently after the reservation takes effect. Such a right requires actual admission as a member, including as a transitional member subject to applicable limitations, or authorization independently conferred by another Act. Permitted intern or supervised operations remain subject to their own rules. Section 15 | ART_ZX716SJXHU9U10V7 | Version 2 A pending application for admission does not authorize use of the title “fire safety practitioner” or the initials “P.S.I.”. A transitional member who actually holds the single permit and is entered on the roll remains subject to the ordinary rules governing the title and disclosure of status and limitations. Section 16 | ART_W8HRD3ZC1FYQ4RVD | Version 4 Neither a pending application nor transitional membership alone automatically confers the right to perform the following acts: 1° give professional approval of a fire safety plan; 2° issue the professional attestation of training or competence reserved to members. The authorization, competency and limitation requirements specific to those acts continue to apply. Rights recognized for engineers, professional technologists, members of other professional orders and other persons independently authorized by law are unchanged. Section 17 | ART_CP9MM2M3YH4V9Z7S | Version 1 Each newly admitted transitional member must complete mandatory initial professional ethics training under the admission regulation; equivalence may only be recognized where permitted by the Code. Section 18 | ART_0QDF7YL06ZHSG59U | Version 1 Pursuant to section 76 of the Act, sections 2, 3, 7, 17, 1 of this regulation are repealed upon final closure of initial admission. Sections 5, 6, 4, 8 are repealed at the same time. The repeal has no retroactive effect and does not erase any file, vested right, payment or earlier act lawfully established.
