OPSI - UNENACTED working proposal v308 | 2026-10-28T08:15:02+00:00 | Corpus 85 DRAFT REGULATION REGULATION RESPECTING SUPPLEMENTARY CERTIFICATIONS IN FIRE SAFETY Section 1 | ART_U8PW696JXNL11LNZ | Version 3 This regulation is made by the board of directors, following the consultation of the Ordre des ingénieurs du Québec and the Ordre des technologues professionnels du Québec required by its enabling provision, and submitted for examination by the Office and government approval under section 95 of the Professional Code. This Regulation, made under section 8 of the Fire Safety Practitioners Act, establishes the only categories of supplementary certifications that Act permits in connection with an intervention already covered by a professional report signed and filed in the registry. It does not authorize replacing the report with a certificate. A “supplementary certification” is a certificate issued under an actual certification programme by an organization authorized to issue it, concerning a specifically defined service or system. An inspection report, test record, training attestation, product listing or mere reference to a standard is not, by itself, such a certification. This Regulation makes neither an optional certification nor a technical requirement mandatory where it is not otherwise legally applicable, and grants no additional authority to perform professional acts reserved under another Act. Section 2 | ART_MQ09X0ANJGZQN94H | Version 1 An active ULC certificate under the fire protective signalling systems certification programme based on CAN/ULC-S561:2020 is permitted as supplementary certification, solely in the following categories: 1° transmission and monitoring of fire alarm system signals to a fire signal receiving centre; 2° transmission and monitoring of alarm or supervisory signals from a sprinkler system to such a centre. The certificate must correspond to a service and system actually eligible under the programme, be issued by a company listed and authorized for the applicable category, and remain valid under the certifier’s rules. The reference to CAN/ULC-S561:2020 defines here a category eligible for optional certification; it does not make that standard mandatory where it is not otherwise legally applicable. Section 3 | ART_TXL82J8F0ZGCQDB5 | Version 1 Supplementary certification may not be requested, obtained or represented as a requirement created by this Act. Where an insurer, owner or other party requests it voluntarily, its subject matter, limitations and duration must be stated unambiguously. The certificate may not replace the signed and filed professional report, erase or minimize its qualifications, conceal unverified matters or non-compliance, or purport to establish general compliance or approval that the certifier did not actually verify. The qualifications and obligations of the person producing or signing the report remain separate from those of the body issuing the certificate. No certification constitutes official approval by a competent authority unless legislation expressly provides otherwise. Section 4 | ART_F2GGJCBALJE3F0FU | Version 1 A supplementary certificate must identify at least its issuer, certification programme and category, the system or service covered, its exact scope, relevant dates, validity period and applicable maintenance or monitoring conditions. Matters not covered must be clearly distinguished. Where feasible and lawful, a reference to the professional report or its filing identifier establishes a documentary link without disclosing protected information. That reference does not amend the filed report, create a second professional report or dispense with any filing or reporting duty. Where the issuer knows of a qualification, non-compliance or significant limitation in the report affecting the subject matter of the certificate, it must avoid any presentation that would conceal it. If that condition cannot be met, the certificate may not be presented as an authorized supplementary certification under this Regulation. Section 5 | ART_D3ZSFZCQ777SD9CS | Version 1 After consulting the Ordre des ingénieurs du Québec and the Ordre des technologues professionnels du Québec, the Order may add, amend or remove permitted supplementary certification categories by amendment of this Regulation. Before adding a category, the Order verifies and documents the existence of an actual certification programme applicable to the service or system concerned, the issuer’s authority to issue a certificate in that category, the verifiable scope of the certificate and its compatibility with the report and non-compliance regime. A standard that merely provides for inspection, testing, verification or reporting, without a certification specific to the proposed category, may not be listed on that basis alone. The Order may publish the categories in force, their effective dates and certification programme documentation for information purposes. Such publication has no regulatory effect and may not add or remove a category without a duly adopted amendment of this Regulation.
