DRAFT REGULATION

REGULATION RESPECTING SUPPLEMENTARY CERTIFICATIONS IN FIRE SAFETY

Genuine optional certification categories, conditions and amendable regulatory list

Proposed authority: Ordre des praticiens en sécurité incendie du Québec, following consultation with the Ordre des ingénieurs du Québec and the Ordre des technologues professionnels du Québec

REGULATION RESPECTING SUPPLEMENTARY CERTIFICATIONS IN FIRE SAFETY

ART_U8PW696JXNL11LNZ

Section 1

Version 3

This regulation is made by the board of directors, following the consultation of the Ordre des ingénieurs du Québec and the Ordre des technologues professionnels du Québec required by its enabling provision, and submitted for examination by the Office and government approval under section 95 of the Professional Code.

This Regulation, made under section 8 (ACT RESPECTING FIRE SAFETY PRACTITIONERS) of the Fire Safety Practitioners Act, establishes the only categories of supplementary certifications that Act permits in connection with an intervention already covered by a professional report signed and filed in the registry. It does not authorize replacing the report with a certificate.

A “supplementary certification” is a certificate issued under an actual certification programme by an organization authorized to issue it, concerning a specifically defined service or system. An inspection report, test record, training attestation, product listing or mere reference to a standard is not, by itself, such a certification.

This Regulation makes neither an optional certification nor a technical requirement mandatory where it is not otherwise legally applicable, and grants no additional authority to perform professional acts reserved under another Act.

REGULATION RESPECTING SUPPLEMENTARY CERTIFICATIONS IN FIRE SAFETY

ART_MQ09X0ANJGZQN94H

Section 2

Version 1

An active ULC certificate under the fire protective signalling systems certification programme based on CAN/ULC-S561:2020 is permitted as supplementary certification, solely in the following categories:

1° transmission and monitoring of fire alarm system signals to a fire signal receiving centre;

2° transmission and monitoring of alarm or supervisory signals from a sprinkler system to such a centre.

The certificate must correspond to a service and system actually eligible under the programme, be issued by a company listed and authorized for the applicable category, and remain valid under the certifier’s rules. The reference to CAN/ULC-S561:2020 defines here a category eligible for optional certification; it does not make that standard mandatory where it is not otherwise legally applicable.

REGULATION RESPECTING SUPPLEMENTARY CERTIFICATIONS IN FIRE SAFETY

ART_TXL82J8F0ZGCQDB5

Section 3

Version 1

Supplementary certification may not be requested, obtained or represented as a requirement created by this Act. Where an insurer, owner or other party requests it voluntarily, its subject matter, limitations and duration must be stated unambiguously.

The certificate may not replace the signed and filed professional report, erase or minimize its qualifications, conceal unverified matters or non-compliance, or purport to establish general compliance or approval that the certifier did not actually verify.

The qualifications and obligations of the person producing or signing the report remain separate from those of the body issuing the certificate. No certification constitutes official approval by a competent authority unless legislation expressly provides otherwise.

REGULATION RESPECTING SUPPLEMENTARY CERTIFICATIONS IN FIRE SAFETY

ART_F2GGJCBALJE3F0FU

Section 4

Version 1

A supplementary certificate must identify at least its issuer, certification programme and category, the system or service covered, its exact scope, relevant dates, validity period and applicable maintenance or monitoring conditions. Matters not covered must be clearly distinguished.

Where feasible and lawful, a reference to the professional report or its filing identifier establishes a documentary link without disclosing protected information. That reference does not amend the filed report, create a second professional report or dispense with any filing or reporting duty.

Where the issuer knows of a qualification, non-compliance or significant limitation in the report affecting the subject matter of the certificate, it must avoid any presentation that would conceal it. If that condition cannot be met, the certificate may not be presented as an authorized supplementary certification under this Regulation.

REGULATION RESPECTING SUPPLEMENTARY CERTIFICATIONS IN FIRE SAFETY

ART_D3ZSFZCQ777SD9CS

Section 5

Version 1

After consulting the Ordre des ingénieurs du Québec and the Ordre des technologues professionnels du Québec, the Order may add, amend or remove permitted supplementary certification categories by amendment of this Regulation.

Before adding a category, the Order verifies and documents the existence of an actual certification programme applicable to the service or system concerned, the issuer’s authority to issue a certificate in that category, the verifiable scope of the certificate and its compatibility with the report and non-compliance regime. A standard that merely provides for inspection, testing, verification or reporting, without a certification specific to the proposed category, may not be listed on that basis alone.

The Order may publish the categories in force, their effective dates and certification programme documentation for information purposes. Such publication has no regulatory effect and may not add or remove a category without a duly adopted amendment of this Regulation.

Your browsing.

A consultation website without advertising.

A consultation website

Public explanatory pages and proposed legal texts can be read without an account. The consultation is not the future central fire-safety registry. No advertising tracker is added.

Accounts and contributions

The database stores your email, public display name, password hash, sponsorship history, comments, voting identifiers, moderation decisions and security audit events. Your email is not displayed publicly. The president and authorized administrators have role-limited access.

Public comments and archives

Published contributions, their public display names and their approved revisions may be consulted and used in an OPSI consultation brief. A comment refers to a precise version of a proposed section. Non-public drafts and sponsorship email addresses are not part of public archives. The participation FAQ explains moderation, retention and requests for correction or withdrawal.

Aggregate audience counts without consent

The public consultation server counts requests by public page, UTC day and hour, successful OPSI document downloads, and selected feature activations, even if you decline optional cookies. The MySQL counters contain no IP address, browser identifier, fingerprint, browsing history, full URL or personally identifiable event record. Counts are requests or actions, not unique visitors or completed reading. Aggregate counts are kept for trend analysis without a defined automatic expiry.

Optional audience statistics

Only if you actively agree, OPSI also uses a signed pseudonymous browser cookie for session and page history, estimated active time, coarse browser/device/OS information, campaign source, referral domain, time-zone offset, approximate viewport dimensions, scrolling and game/feature-use events (never answers or typed text). No IP address or complete user-agent string is kept in these optional statistical records. The data are accessible only to the president and kept for 395 days by default (the hosting retention value may differ). Withdrawal stops tracking immediately and requests deletion of the associated browser history. A browser does not prove a unique person.

Technical and security logs

The host, web server and security services may separately process IP addresses to protect the infrastructure, prevent abuse and investigate incidents when demonstrably necessary. Such technical records are not joined to audience statistics or used to reconstruct the journeys of people who refuse tracking. Their actual fields, authorized access, retention and deletion schedule, as well as Apache/proxy logs and backups, must be verified and documented with the hosting provider before launch; PHP cannot control their expiry.

Cookies and local progress

Sign-in uses a secure session cookie. A signed browser identifier limits repeated votes, without proving a unique person. With your separate optional agreement, the site can save learning progress and the history of questions you submit on your device (up to one year). Without agreement, learning and question history remain only in the current page memory; the games still work. Theme changes and game scores use local preferences. Technical rate-limit records are periodically purged. You can change or withdraw optional choices from the footer.

Email

Verification, sponsorship and account-recovery messages use the server-configured transport. When Microsoft Graph is enabled, necessary delivery information is sent to that service. Delivery is not guaranteed merely because the service accepted a message.

Retention and your requests

Legislative archives and contribution history are retained for consultation traceability; withdrawal normally hides a comment without erasing its history. Exceptional redaction is separately controlled and logged. Contact info@opsi.info (privacy officer contact for this project, subject to confirmation of the designated person) for access, correction, withdrawal or retention questions. Pseudonymized records remain personal information; counters created without identifiers must not be misrepresented as anonymization of existing personal data. The operator must validate the legal grounds and retention schedules. This implementation is not a legal compliance certificate.
