ART_8F04MG4DB55E12VQ

In particular, a member must not make classification as a non-compliance under documented action, maintenance of that classification or reclassification from a non-compliance requiring action to a non-compliance under documented action conditional on corrective work being awarded to the member, the member’s employer or a related person. A client’s refusal to award that work, negotiation of a price or selection of another provider must not influence professional judgment.

A member must not present a non-compliance as a non-compliance under documented action or a non-compliance requiring action where it does not meet the applicable serious-risk threshold, nor exaggerate urgency or unduly shorten a deadline in order to generate work that protection of the public does not require with that degree of urgency.

CODE OF ETHICS OF FIRE SAFETY PRACTITIONERS

ART_B2GXQLUYA9W7GXR9

Section 48

Version 2

Where a member practises within a body subject to special statutory rules governing access, correction, retention or release of records, the member complies with those rules and facilitates their application. The following sections apply subject to those special rules.

A member who prepared or approved a document filed in the registry and who may lawfully supply a copy also responds diligently, and within the period set out in the first paragraph, to a legitimate request from the owner or authorized representative. A member who accepts a limited mandate to provide a copy is subject to the same requirement. Section 54

Version 2

Where a member grants a request for correction or deletion, the member provides the client, free of charge, with a copy of the document or part of the document showing the correction or, as the case may be, an attestation of deletion.

Where required by law or reasonably necessary to prevent inaccurate information from continuing to be used, the member takes permitted measures to bring the correction to the attention of persons to whom the information was communicated.

CODE OF ETHICS OF FIRE SAFETY PRACTITIONERS

ART_STBBJ5D47LHL7X2Z

Section 55

Version 2

Where a member refuses a request for correction or deletion, the member informs the client in writing of the refusal and the reasons for it. In all cases, the member allows the client to have written comments placed in the record, subject to the law.

CODE OF ETHICS OF FIRE SAFETY PRACTITIONERS

ART_8YL4WZDZUCG6BLFL

Section 56

Version 2

At the client’s request or at the end of the mandate, a member diligently returns originals belonging to or entrusted by the client and provides reports, attestations, results and other documents to which the client is entitled and that are necessary for reasonable continuity of the file.

Non-payment of fees does not entitle a member to withhold a document where withholding is likely to compromise a person’s safety, the exercise of a right or continuity of a professional service.

Where a record is kept by an employer or firm, the member facilitates delivery of documents to the extent of their powers and access rights, in cooperation with the custodian and under applicable law.

CODE OF ETHICS OF FIRE SAFETY PRACTITIONERS

ART_YSM3AH1VWLC460A9

Section 57

Version 3

Where a mandate is transferred to another professional or legally authorized person, a member cooperates, in accordance with the client’s instructions and confidentiality rules, in transferring the information and documents required.

The member may retain copies and working documents that the member is authorized or required to retain, subject to the client’s access rights and the rules governing record keeping.

Transfer of custody of records does not, by itself, entail acceptance of a mandate or approval of earlier reports. Under applicable law, the client retains the choice of a new professional.

Where called upon to collaborate with another professional in a joint mandate or interdependent mandates, the member must act with diligence, good faith, courtesy and respect, and foster effective coordination of interventions while respecting each person’s professional independence and obligations.

Section 58

Version 2

A member informs the syndic where the member has reason to believe that a situation likely to affect the competence or integrity of another member of the Order has arisen.

This obligation does not require the member to conduct a disciplinary investigation. The member communicates in good faith the relevant facts and information known to the member, in compliance with professional secrecy and other applicable rules of law.

ART_2JEVN1TY5FF6DYSC

Section 64

Version 2

A member supervising a candidate, trainee, employee or other person remains responsible for every professional act the member signs, authenticates, approves or files.

The member assigns to a supervised person only tasks compatible with that person’s training, experience, status and level of competence and provides supervision appropriate to the risk of the activity.

Supervision within an enterprise, firm or multidisciplinary organization does not transfer personal accountability for acts approved by the member or require a member to endorse another person’s professional judgment.

CODE OF ETHICS OF FIRE SAFETY PRACTITIONERS

ART_CQ155DMTDN6XCMF4

Section 68

Version 2

A member does not solicit a person in an insidious, pressing or repeated manner. ART_XNEVED9AM0FR0FLD

Section 69

Your browsing.

A consultation website without advertising.

A consultation website

Public explanatory pages and proposed legal texts can be read without an account. The consultation is not the future central fire-safety registry. No advertising tracker is added.

Accounts and contributions

The database stores your email, public display name, password hash, sponsorship history, comments, voting identifiers, moderation decisions and security audit events. Your email is not displayed publicly. The president and authorized administrators have role-limited access.

Public comments and archives

Published contributions, their public display names and their approved revisions may be consulted and used in an OPSI consultation brief. A comment refers to a precise version of a proposed section. Non-public drafts and sponsorship email addresses are not part of public archives. The participation FAQ explains moderation, retention and requests for correction or withdrawal.

Aggregate audience counts without consent

The public consultation server counts requests by public page, UTC day and hour, successful OPSI document downloads, and selected feature activations, even if you decline optional cookies. The MySQL counters contain no IP address, browser identifier, fingerprint, browsing history, full URL or personally identifiable event record. Counts are requests or actions, not unique visitors or completed reading. Aggregate counts are kept for trend analysis without a defined automatic expiry.

Optional audience statistics

Only if you actively agree, OPSI also uses a signed pseudonymous browser cookie for session and page history, estimated active time, coarse browser/device/OS information, campaign source, referral domain, time-zone offset, approximate viewport dimensions, scrolling and game/feature-use events (never answers or typed text). No IP address or complete user-agent string is kept in these optional statistical records. The data are accessible only to the president and kept for 395 days by default (the hosting retention value may differ). Withdrawal stops tracking immediately and requests deletion of the associated browser history. A browser does not prove a unique person.

Technical and security logs

The host, web server and security services may separately process IP addresses to protect the infrastructure, prevent abuse and investigate incidents when demonstrably necessary. Such technical records are not joined to audience statistics or used to reconstruct the journeys of people who refuse tracking. Their actual fields, authorized access, retention and deletion schedule, as well as Apache/proxy logs and backups, must be verified and documented with the hosting provider before launch; PHP cannot control their expiry.

Cookies and local progress

Sign-in uses a secure session cookie. A signed browser identifier limits repeated votes, without proving a unique person. With your separate optional agreement, the site can save learning progress and the history of questions you submit on your device (up to one year). Without agreement, learning and question history remain only in the current page memory; the games still work. Theme changes and game scores use local preferences. Technical rate-limit records are periodically purged. You can change or withdraw optional choices from the footer.

Email

Verification, sponsorship and account-recovery messages use the server-configured transport. When Microsoft Graph is enabled, necessary delivery information is sent to that service. Delivery is not guaranteed merely because the service accepted a message.

Retention and your requests

Legislative archives and contribution history are retained for consultation traceability; withdrawal normally hides a comment without erasing its history. Exceptional redaction is separately controlled and logged. Contact info@opsi.info (privacy officer contact for this project, subject to confirmation of the designated person) for access, correction, withdrawal or retention questions. Pseudonymized records remain personal information; counters created without identifiers must not be misrepresented as anonymization of existing personal data. The operator must validate the legal grounds and retention schedules. This implementation is not a legal compliance certificate.
