DRAFT ORDER REGULATION

REGULATION RESPECTING THE KEEPING, PRESERVATION, TRANSFER AND INTERIM CUSTODY OF PROFESSIONAL RECORDS OF MEMBERS OF THE OPSI

Employer or firm custody, digital preservation, successor custodians and documentary continuity

Proposed authority: Regulation of the Order’s board of directors

Chapter I

PURPOSE, ACCOUNTABILITY AND SINGLE RECORD

REGULATION RESPECTING THE KEEPING, PRESERVATION, TRANSFER AND INTERIM CUSTODY OF PROFESSIONAL RECORDS OF MEMBERS OF THE OPSI

ART_8ZH3CBMF42ZKVVFU

Section 1

Version 3

This regulation is made by the board of directors under section 91 of the Professional Code, following communication to members under section 95.3, and approved by the Office under section 95.2.

This Regulation governs the creation, maintenance, custody, preservation and continuity of professional records of members of the Order, including members employed by an organization or practising in a firm. It applies within the powers conferred by the Professional Code and the proposed constituting Act.

REGULATION RESPECTING THE KEEPING, PRESERVATION, TRANSFER AND INTERIM CUSTODY OF PROFESSIONAL RECORDS OF MEMBERS OF THE OPSI

ART_UHU5P4TA62TJEWV7

Section 2

Version 2

Responsibility for professional acts, reports, conclusions and approvals rests with the member who performs, signs or approves them. Physical custody of a record may be assigned to an eligible custodian; filing with the central registry is a separate duty. Neither mechanism transfers professional judgment.

REGULATION RESPECTING THE KEEPING, PRESERVATION, TRANSFER AND INTERIM CUSTODY OF PROFESSIONAL RECORDS OF MEMBERS OF THE OPSI

ART_V5G87TQ6PAC6GL9X

Section 3

Version 2

One properly created and preserved professional record held by the self-employed member or by an eligible organization satisfies the recordkeeping requirement. An employee or firm member need not maintain a second identical personal archive where the organization has a compliant system.

REGULATION RESPECTING THE KEEPING, PRESERVATION, TRANSFER AND INTERIM CUSTODY OF PROFESSIONAL RECORDS OF MEMBERS OF THE OPSI

ART_3CHC3BS2NDTX1G7P

Section 4

Version 2

The member ensures that records relating to their mandates can be retrieved through an adequate filing system. This Regulation requires no additional personal register, systematic parallel inventory or duplicate documentary filing.

Chapter II

CREATION, CUSTODY AND ACCESS

REGULATION RESPECTING THE KEEPING, PRESERVATION, TRANSFER AND INTERIM CUSTODY OF PROFESSIONAL RECORDS OF MEMBERS OF THE OPSI

ART_9YPKRLZWANSG11KR

Section 5

Version 2

As warranted by the mandate, the record contains the identifying information needed for the client, building and mandate; relevant preliminary, final and corrected reports; observations and test results; useful photographs and technical material; essential calculations, notes and reasons; important communications; and confirmations of registry filings and required transmissions.

For acceptance, commissioning or integrated tests, relevant records include, as required by the scope, test plans or sequences, allocation of responsibilities, pertinent results and evidence, tests not performed and stated reservations, without requiring duplicate copies or documents unrelated to the mandate.

REGULATION RESPECTING THE KEEPING, PRESERVATION, TRANSFER AND INTERIM CUSTODY OF PROFESSIONAL RECORDS OF MEMBERS OF THE OPSI

ART_SPCJ5BE45QT8P3PL

Section 6

Version 2

Materials must be kept insofar as needed to understand or substantiate the professional act. This Regulation does not require indiscriminate retention of every draft, duplicate, professionally irrelevant datum or document outside the mandate.

REGULATION RESPECTING THE KEEPING, PRESERVATION, TRANSFER AND INTERIM CUSTODY OF PROFESSIONAL RECORDS OF MEMBERS OF THE OPSI

ART_99ZE2G8DV9SLFB5T

Section 7

Version 2

Where a member is an employee, the employer may maintain and preserve the records of services performed by that member if the member can enter their professional acts and supporting information and the custodian complies with this Regulation. Being an employer alone does not constitute authorization to practise through a regulated professional firm.

REGULATION RESPECTING THE KEEPING, PRESERVATION, TRANSFER AND INTERIM CUSTODY OF PROFESSIONAL RECORDS OF MEMBERS OF THE OPSI

ART_PKY7JF01X02XWZWD

Section 8

Version 2

The member obtains the organizational custodian’s necessary undertakings to access, during and after employment, only those portions of their records needed to fulfil professional rights and obligations, including responding to a complaint, claim, syndic investigation or professional inspection. Such access is restricted, secured and subject to applicable law and confidentiality; it conveys no general right to take or exploit an employer’s files.

REGULATION RESPECTING THE KEEPING, PRESERVATION, TRANSFER AND INTERIM CUSTODY OF PROFESSIONAL RECORDS OF MEMBERS OF THE OPSI

ART_95101QX9EGX685AM

Section 9

Version 2

An eligible professional firm may create, organize and preserve records shared by members practising there. It designates a records officer and makes the required information available to each member while maintaining documentary continuity. Each member remains individually accountable for the acts they perform or approve.

REGULATION RESPECTING THE KEEPING, PRESERVATION, TRANSFER AND INTERIM CUSTODY OF PROFESSIONAL RECORDS OF MEMBERS OF THE OPSI

ART_AZVRTG771C3WHZ1R

Section 10

Version 2

Where records are shared with other professionals, information is accessed according to legal authority and actual need for the mandate. Professional secrecy, legal protections and privileged information belonging to other professions do not become generally accessible solely through joint practice.

Chapter III

MEDIA, RETENTION AND INTEGRITY

REGULATION RESPECTING THE KEEPING, PRESERVATION, TRANSFER AND INTERIM CUSTODY OF PROFESSIONAL RECORDS OF MEMBERS OF THE OPSI

ART_08NG7HM1X9ZZG40S

Section 11

Version 2

Filing a report or other document in the central registry never replaces the duty to create and preserve a professional record, including supporting material, outside that registry. The “My reports” registry feature does not replace observations, notes, results, photographs or other parts of the professional record.

REGULATION RESPECTING THE KEEPING, PRESERVATION, TRANSFER AND INTERIM CUSTODY OF PROFESSIONAL RECORDS OF MEMBERS OF THE OPSI

ART_S94LMLWJZXN77AT7

Section 12

Version 2

The document filed in the registry remains the official reference for that filing. The local custodian keeps an appropriate independent copy and must not silently alter a signed or filed version; any correction follows the applicable procedure and identifies the versions and their authors.

REGULATION RESPECTING THE KEEPING, PRESERVATION, TRANSFER AND INTERIM CUSTODY OF PROFESSIONAL RECORDS OF MEMBERS OF THE OPSI

ART_KZV6HRDUL2FVBGED

Section 13

Version 2

Records may be kept on paper, in digital form, in a business system or with a compliant storage provider. The custodian implements reasonable and proportionate protections against loss, illegitimate access, alteration, accidental destruction and unauthorized disclosure.

REGULATION RESPECTING THE KEEPING, PRESERVATION, TRANSFER AND INTERIM CUSTODY OF PROFESSIONAL RECORDS OF MEMBERS OF THE OPSI

ART_4T1JZVMGLQ5YV4FU

Section 14

Version 2

Digital records must have recoverable backups, intelligible filing, appropriate access controls and a reasonable ability to export or transfer records when the custodian changes. No physical vault, notarial repository, specialized facility or general paper-printing requirement is imposed.

REGULATION RESPECTING THE KEEPING, PRESERVATION, TRANSFER AND INTERIM CUSTODY OF PROFESSIONAL RECORDS OF MEMBERS OF THE OPSI

ART_662S3FKL4A0322X2

Section 15

Version 2

A closed professional file must be retained for at least ten years from its actual closure. A longer valid statutory or contractual duty, active inquiry, complaint, claim or litigation takes precedence over that minimum.

The ten-year period governs the separate professional file, not the retention lifecycle of filings, EDF_ identifier or data in the central registry. The final duration remains subject to legal validation of authority and suitability for fire-safety risks.

REGULATION RESPECTING THE KEEPING, PRESERVATION, TRANSFER AND INTERIM CUSTODY OF PROFESSIONAL RECORDS OF MEMBERS OF THE OPSI

ART_R3V5K1A2UUSNA8NT

Section 16

Version 2

The custodian retains every active file during the mandate and for at least ten years after its actual closure under section 15 (REGULATION RESPECTING THE KEEPING, PRESERVATION, TRANSFER AND INTERIM CUSTODY OF PROFESSIONAL RECORDS OF MEMBERS OF THE OPSI). Retention is extended where required by a complaint, claim, investigation, professional inspection, litigation, preservation order or another valid statutory or contractual duty, until the reason for the extension has actually ended.

An employer or firm holding compliant records applies the same rule and arranges necessary PSI access without automatically requiring a duplicate personal archive. A scheduled destruction date never authorizes destruction of evidence that must still be preserved.

REGULATION RESPECTING THE KEEPING, PRESERVATION, TRANSFER AND INTERIM CUSTODY OF PROFESSIONAL RECORDS OF MEMBERS OF THE OPSI

ART_HEDD4AHT0TT4A6G5

Section 17

Version 2

After the ten-year period in section 15 (REGULATION RESPECTING THE KEEPING, PRESERVATION, TRANSFER AND INTERIM CUSTODY OF PROFESSIONAL RECORDS OF MEMBERS OF THE OPSI) and all extensions under section 16 (REGULATION RESPECTING THE KEEPING, PRESERVATION, TRANSFER AND INTERIM CUSTODY OF PROFESSIONAL RECORDS OF MEMBERS OF THE OPSI) have expired, the custodian may securely destroy materials no longer legally required, protecting confidentiality and documenting destruction where appropriate. Remaining access rights and the separate retention rules for the central registry continue to apply.

Chapter IV

TRANSFER AND INTERIM CUSTODY

REGULATION RESPECTING THE KEEPING, PRESERVATION, TRANSFER AND INTERIM CUSTODY OF PROFESSIONAL RECORDS OF MEMBERS OF THE OPSI

ART_CA687MCEXWV4D9N1

Section 18

Version 2

A self-employed professional who holds their own records designates an eligible successor custodian who accepts the designation in writing. The professional keeps the custodian’s details and consent current and provides an alternate person or fallback procedure if that custodian becomes unavailable.

REGULATION RESPECTING THE KEEPING, PRESERVATION, TRANSFER AND INTERIM CUSTODY OF PROFESSIONAL RECORDS OF MEMBERS OF THE OPSI

ART_81ADJ55JBF3N5167

Section 19

Version 2

An employee or firm member need not designate a personal successor custodian where the employer or firm maintains records under this Regulation and has an effective continuity plan. The organization then arranges an eligible successor or interim custodian in the event of closure.

REGULATION RESPECTING THE KEEPING, PRESERVATION, TRANSFER AND INTERIM CUSTODY OF PROFESSIONAL RECORDS OF MEMBERS OF THE OPSI

ART_APXGKZ5TBKYQBFK0

Section 20

Version 2

Continuity measures apply in particular upon death, incapacity, cessation of practice, suspension or removal from the roll that jeopardizes custody, dissolution or closure of an organization and prolonged unavailability of the custodian.

REGULATION RESPECTING THE KEEPING, PRESERVATION, TRANSFER AND INTERIM CUSTODY OF PROFESSIONAL RECORDS OF MEMBERS OF THE OPSI

ART_PFDPFAR233AF3MKR

Section 21

Version 2

On a continuity event, the custodian or representative gives the Order the notices legally required, prepares an adequate inventory of the affected records, identifies the successor or interim custodian and arranges a secure, traceable transfer respecting professional secrecy. Deadlines and formalities must reflect urgency and the size of the practice.

REGULATION RESPECTING THE KEEPING, PRESERVATION, TRANSFER AND INTERIM CUSTODY OF PROFESSIONAL RECORDS OF MEMBERS OF THE OPSI

ART_J6AURT8NCYNM7UNS

Section 22

Version 2

A successor or interim custodian undertakes only custody, protection, legally authorized access and retrieval of records. They do not assume prior reports, earlier conclusions or incomplete mandates without a new express acceptance permitted by law. Past reports do not require fresh approval.

REGULATION RESPECTING THE KEEPING, PRESERVATION, TRANSFER AND INTERIM CUSTODY OF PROFESSIONAL RECORDS OF MEMBERS OF THE OPSI

ART_2KDSFCP7MB7X6Q5C

Section 23

Version 2

The client retains, under applicable law, the choice of the authorized professional who will continue a mandate. Documentary transfer needed for that choice does not automatically transfer the mandate to the custodian.

REGULATION RESPECTING THE KEEPING, PRESERVATION, TRANSFER AND INTERIM CUSTODY OF PROFESSIONAL RECORDS OF MEMBERS OF THE OPSI

ART_SFDPEWZFKK812GVV

Section 24

Version 2

If the designated successor is unavailable or no eligible custodian preserves continuity, the Order may use the subsidiary custody or appointment mechanisms legally assigned to it, within its powers and without automatically becoming permanent custodian of all private professional records.

Retirement, removal from the roll or cessation of practice does not transfer professional liability for prior acts to a custodian. Former practitioners retain lawfully necessary defensive access through a secured and proportionate process distinct from general registry access.

Your browsing.

A consultation website without advertising.

A consultation website

Public explanatory pages and proposed legal texts can be read without an account. The consultation is not the future central fire-safety registry. No advertising tracker is added.

Accounts and contributions

The database stores your email, public display name, password hash, sponsorship history, comments, voting identifiers, moderation decisions and security audit events. Your email is not displayed publicly. The president and authorized administrators have role-limited access.

Public comments and archives

Published contributions, their public display names and their approved revisions may be consulted and used in an OPSI consultation brief. A comment refers to a precise version of a proposed section. Non-public drafts and sponsorship email addresses are not part of public archives. The participation FAQ explains moderation, retention and requests for correction or withdrawal.

Aggregate audience counts without consent

The public consultation server counts requests by public page, UTC day and hour, successful OPSI document downloads, and selected feature activations, even if you decline optional cookies. The MySQL counters contain no IP address, browser identifier, fingerprint, browsing history, full URL or personally identifiable event record. Counts are requests or actions, not unique visitors or completed reading. Aggregate counts are kept for trend analysis without a defined automatic expiry.

Optional audience statistics

Only if you actively agree, OPSI also uses a signed pseudonymous browser cookie for session and page history, estimated active time, coarse browser/device/OS information, campaign source, referral domain, time-zone offset, approximate viewport dimensions, scrolling and game/feature-use events (never answers or typed text). No IP address or complete user-agent string is kept in these optional statistical records. The data are accessible only to the president and kept for 395 days by default (the hosting retention value may differ). Withdrawal stops tracking immediately and requests deletion of the associated browser history. A browser does not prove a unique person.

Technical and security logs

The host, web server and security services may separately process IP addresses to protect the infrastructure, prevent abuse and investigate incidents when demonstrably necessary. Such technical records are not joined to audience statistics or used to reconstruct the journeys of people who refuse tracking. Their actual fields, authorized access, retention and deletion schedule, as well as Apache/proxy logs and backups, must be verified and documented with the hosting provider before launch; PHP cannot control their expiry.

Cookies and local progress

Sign-in uses a secure session cookie. A signed browser identifier limits repeated votes, without proving a unique person. With your separate optional agreement, the site can save learning progress and the history of questions you submit on your device (up to one year). Without agreement, learning and question history remain only in the current page memory; the games still work. Theme changes and game scores use local preferences. Technical rate-limit records are periodically purged. You can change or withdraw optional choices from the footer.

Email

Verification, sponsorship and account-recovery messages use the server-configured transport. When Microsoft Graph is enabled, necessary delivery information is sent to that service. Delivery is not guaranteed merely because the service accepted a message.

Retention and your requests

Legislative archives and contribution history are retained for consultation traceability; withdrawal normally hides a comment without erasing its history. Exceptional redaction is separately controlled and logged. Contact info@opsi.info (privacy officer contact for this project, subject to confirmation of the designated person) for access, correction, withdrawal or retention questions. Pseudonymized records remain personal information; counters created without identifiers must not be misrepresented as anonymization of existing personal data. The operator must validate the legal grounds and retention schedules. This implementation is not a legal compliance certificate.
