OPSI - UNENACTED working proposal v308 | 2026-10-28T08:20:22+00:00 | Corpus 85 DRAFT TRANSITIONAL REGULATION REGULATION RESPECTING THE PROGRESSIVE IMPLEMENTATION OF THE ACT AND THE REGISTRY I - PRINCIPLES Section 1 | ART_51JSCCJA8M81BXUD | Version 5 This transitional regulation is made by the board of directors under section 61 of the Act, examined by the Office and approved by the Government under section 95 of the Professional Code, subject to the initial enabling power in section 57. It does not change commencement or activation dates fixed by the Government. The official authorized-organization register and the three verification directories under section 33 of the Act may begin operating with the Order's professional functions, without waiting for regional activation of the documentary registry. Their public version is hosted on the independent second server; no entry may imply that an Order not yet legally constituted or an organization not yet authorized already enjoys official status. Section 2 | ART_S89WL0DDS1KPQVVF | Version 1 Implementation may be organized in phases in order to ensure: 1° continuity of services; 2° availability of professionals; 3° operation of the registry; 4° training of the persons concerned; 5° an orderly transition from existing practices. Legal establishment of the Order and commencement of professional oversight precede mandatory deployment of the documentary registry. The monthly administrative pre-registry permits lawful collection before full filing without requesting report files. Section 3 | ART_5P8BVY14B1UJCTAF | Version 2 The phases may be distinguished according to: 1° activities; 2° systems; 3° documents; 4° categories of buildings; 5° regions; 6° categories of persons; 7° registry functionalities. II - IMPLEMENTATION PLAN Section 4 | ART_9HE47XGTRDJA58A9 | Version 2 The board of directors adopts and publishes an implementation plan compatible with the coming-into-force dates determined by the Government. The government sets the legal activation dates for all 17 regions. The first board of the Order may not bring them forward and publishes only the corresponding operational plan. Section 5 | ART_K61CJB2C36U3JF3Z | Version 2 The plan must indicate, in particular: 1° the phases; 2° the activities concerned; 3° operational dates; 4° filing obligations; 5° transitional measures; 6° user-support mechanisms. The plan sets out three phases: constituted and operating Order; stabilization, pre-registry and secure development for a minimum of 24 months after the first board takes office; then progressive regional activation of the full registry. Section 6 | ART_8GNW3KH3FPEFNCWA | Version 2 A significant amendment to the plan is published before it is applied where circumstances permit. III - REGISTRY Section 7 | ART_7M9B37QJTW9SAQFK | Version 2 The registry may be deployed progressively by category of documents or users. Regional activation begins with regions having the fewest buildings actually subject to the scheme and progresses towards those with the most. Rankings rely on a verified, deduplicated administrative census and are only published as definitive once those data are validated. Section 8 | ART_QYG3RCYQPB02SKAS | Version 1 Tests and partial commissioning under section 67 of the Act may proceed in waves, with volunteer professionals and competent authorities and defined functionalities. The plan states the duration, verifiable objectives, admission criteria and withdrawal conditions. Demonstration environments are separate from official filings. The plan specifies confidentiality, logging and security measures, and procedures for terminating or expanding pilot access. No stage of the plan constitutes mandatory regional activation or diminishes independent safety or reporting duties. Section 9 | ART_M2WE6QCYBNS8CPPG | Version 2 When a category becomes mandatory, documents produced after that date are filed in accordance with the regulation respecting the registry. No filing obligation begins in a region before the government’s activation date. Earlier reports are not subject to general retrospective filing, and no missing-report alerts are generated in an inactive region. Section 10 | ART_Y7FEDTXA00QP5992 | Version 2 The Order may provide for a limited period of deferred filing in the event of an exceptional technological deployment difficulty. Such a measure may not delay communication of non-compliance requiring action or a mandatory declaration to the competent authority. A technical difficulty does not authorize the Order itself to advance or postpone a legal date set by the government; all measures remain subject to the Act and independently applicable safety obligations. IV - RESERVED ACTIVITIES Section 11 | ART_F7A2TEUGX0HFB7PP | Version 2 Reserved activities may come into force on different dates according to the categories provided for by the Act. The minimum 24-month registry period is neither a maximum initial-admission period nor an automatic expiry date for transitional status, training or an education pathway. Section 12 | ART_4XK2PBXMCSBWU675 | Version 2 When an activity becomes reserved, a person who is neither a member nor otherwise legally authorized must cease carrying it out except for operations permitted to an intern or under authorized supervision. Independent performance of an act reserved under the Order’s transitional regime requires actual admission as a transitional member holding the single permit and subject to its limitations. Authorizations independently granted under another Act remain unchanged. V - FINAL PROVISIONS Section 13 | ART_3DEFAJ0UPPZ5MSB1 | Version 2 No transitional measure may be interpreted as reducing an obligation to report a dangerous situation once such an obligation has come into force. Section 14 | ART_VT1PUCK14X2R6P27 | Version 2 Pursuant to section 75 of the Act, sections 3, 7, 6, 4, 5 of this regulation are repealed upon completion of mandatory regional deployment. Sections 8, 2 and 10 are repealed at the same time. The repeal has no retroactive effect and does not erase any file, vested right, payment or earlier act lawfully established.
