DRAFT TRANSITIONAL REGULATION

REGULATION RESPECTING THE PROGRESSIVE IMPLEMENTATION OF THE ACT AND THE REGISTRY

Phased implementation of the Act and registry

Proposed authority: Regulation of the Order’s board of directors

Chapter I

PRINCIPLES

REGULATION RESPECTING THE PROGRESSIVE IMPLEMENTATION OF THE ACT AND THE REGISTRY

ART_51JSCCJA8M81BXUD

Section 1

Version 5

This transitional regulation is made by the board of directors under section 61 (ACT RESPECTING FIRE SAFETY PRACTITIONERS) of the Act, examined by the Office and approved by the Government under section 95 of the Professional Code, subject to the initial enabling power in section 57 (ACT RESPECTING FIRE SAFETY PRACTITIONERS). It does not change commencement or activation dates fixed by the Government.

The official authorized-organization register and the three verification directories under section 33 (ACT RESPECTING FIRE SAFETY PRACTITIONERS) of the Act may begin operating with the Order's professional functions, without waiting for regional activation of the documentary registry. Their public version is hosted on the independent second server; no entry may imply that an Order not yet legally constituted or an organization not yet authorized already enjoys official status.

REGULATION RESPECTING THE PROGRESSIVE IMPLEMENTATION OF THE ACT AND THE REGISTRY

ART_S89WL0DDS1KPQVVF

Section 2

Version 1
Temporary provision — Scheduled repeal after mandatory activation of all seventeen regions. See sunset provision

Implementation may be organized in phases in order to ensure:

1° continuity of services;

2° availability of professionals;

3° operation of the registry;

4° training of the persons concerned;

5° an orderly transition from existing practices.

Legal establishment of the Order and commencement of professional oversight precede mandatory deployment of the documentary registry. The monthly administrative pre-registry permits lawful collection before full filing without requesting report files.

REGULATION RESPECTING THE PROGRESSIVE IMPLEMENTATION OF THE ACT AND THE REGISTRY

ART_5P8BVY14B1UJCTAF

Section 3

Version 2
Temporary provision — Scheduled repeal after mandatory activation of all seventeen regions. See sunset provision

The phases may be distinguished according to:

1° activities;

2° systems;

3° documents;

4° categories of buildings;

5° regions;

6° categories of persons;

7° registry functionalities.

Chapter II

IMPLEMENTATION PLAN

REGULATION RESPECTING THE PROGRESSIVE IMPLEMENTATION OF THE ACT AND THE REGISTRY

ART_9HE47XGTRDJA58A9

Section 4

Version 2
Temporary provision — Scheduled repeal after mandatory activation of all seventeen regions. See sunset provision

The board of directors adopts and publishes an implementation plan compatible with the coming-into-force dates determined by the Government.

The government sets the legal activation dates for all 17 regions. The first board of the Order may not bring them forward and publishes only the corresponding operational plan.

REGULATION RESPECTING THE PROGRESSIVE IMPLEMENTATION OF THE ACT AND THE REGISTRY

ART_K61CJB2C36U3JF3Z

Section 5

Version 2
Temporary provision — Scheduled repeal after mandatory activation of all seventeen regions. See sunset provision

The plan must indicate, in particular:

1° the phases;

2° the activities concerned;

3° operational dates;

4° filing obligations;

5° transitional measures;

6° user-support mechanisms.

The plan sets out three phases: constituted and operating Order; stabilization, pre-registry and secure development for a minimum of 24 months after the first board takes office; then progressive regional activation of the full registry.

REGULATION RESPECTING THE PROGRESSIVE IMPLEMENTATION OF THE ACT AND THE REGISTRY

ART_8GNW3KH3FPEFNCWA

Section 6

Version 2
Temporary provision — Scheduled repeal after mandatory activation of all seventeen regions. See sunset provision

A significant amendment to the plan is published before it is applied where circumstances permit.

Chapter III

REGISTRY

REGULATION RESPECTING THE PROGRESSIVE IMPLEMENTATION OF THE ACT AND THE REGISTRY

ART_7M9B37QJTW9SAQFK

Section 7

Version 2
Temporary provision — Scheduled repeal after mandatory activation of all seventeen regions. See sunset provision

The registry may be deployed progressively by category of documents or users.

Regional activation begins with regions having the fewest buildings actually subject to the scheme and progresses towards those with the most. Rankings rely on a verified, deduplicated administrative census and are only published as definitive once those data are validated.

REGULATION RESPECTING THE PROGRESSIVE IMPLEMENTATION OF THE ACT AND THE REGISTRY

ART_QYG3RCYQPB02SKAS

Section 8

Version 1
Temporary provision — Scheduled repeal after mandatory activation of all seventeen regions. See sunset provision

Tests and partial commissioning under section 67 (ACT RESPECTING FIRE SAFETY PRACTITIONERS) of the Act may proceed in waves, with volunteer professionals and competent authorities and defined functionalities. The plan states the duration, verifiable objectives, admission criteria and withdrawal conditions.

Demonstration environments are separate from official filings. The plan specifies confidentiality, logging and security measures, and procedures for terminating or expanding pilot access.

No stage of the plan constitutes mandatory regional activation or diminishes independent safety or reporting duties.

REGULATION RESPECTING THE PROGRESSIVE IMPLEMENTATION OF THE ACT AND THE REGISTRY

ART_M2WE6QCYBNS8CPPG

Section 9

Version 2

When a category becomes mandatory, documents produced after that date are filed in accordance with the regulation respecting the registry.

No filing obligation begins in a region before the government’s activation date. Earlier reports are not subject to general retrospective filing, and no missing-report alerts are generated in an inactive region.

REGULATION RESPECTING THE PROGRESSIVE IMPLEMENTATION OF THE ACT AND THE REGISTRY

ART_Y7FEDTXA00QP5992

Section 10

Version 2

The Order may provide for a limited period of deferred filing in the event of an exceptional technological deployment difficulty.

Such a measure may not delay communication of non-compliance requiring action or a mandatory declaration to the competent authority.

A technical difficulty does not authorize the Order itself to advance or postpone a legal date set by the government; all measures remain subject to the Act and independently applicable safety obligations.

Chapter IV

RESERVED ACTIVITIES

REGULATION RESPECTING THE PROGRESSIVE IMPLEMENTATION OF THE ACT AND THE REGISTRY

ART_F7A2TEUGX0HFB7PP

Section 11

Version 2

Reserved activities may come into force on different dates according to the categories provided for by the Act.

The minimum 24-month registry period is neither a maximum initial-admission period nor an automatic expiry date for transitional status, training or an education pathway.

REGULATION RESPECTING THE PROGRESSIVE IMPLEMENTATION OF THE ACT AND THE REGISTRY

ART_4XK2PBXMCSBWU675

Section 12

Version 2

When an activity becomes reserved, a person who is neither a member nor otherwise legally authorized must cease carrying it out except for operations permitted to an intern or under authorized supervision. Independent performance of an act reserved under the Order’s transitional regime requires actual admission as a transitional member holding the single permit and subject to its limitations. Authorizations independently granted under another Act remain unchanged.

Chapter V

FINAL PROVISIONS

REGULATION RESPECTING THE PROGRESSIVE IMPLEMENTATION OF THE ACT AND THE REGISTRY

ART_3DEFAJ0UPPZ5MSB1

Section 13

Version 2

No transitional measure may be interpreted as reducing an obligation to report a dangerous situation once such an obligation has come into force.

REGULATION RESPECTING THE PROGRESSIVE IMPLEMENTATION OF THE ACT AND THE REGISTRY

ART_VT1PUCK14X2R6P27

Section 14

Version 2

Pursuant to section 75 (ACT RESPECTING FIRE SAFETY PRACTITIONERS) of the Act, sections 3 (REGULATION RESPECTING THE PROGRESSIVE IMPLEMENTATION OF THE ACT AND THE REGISTRY), 7 (REGULATION RESPECTING THE PROGRESSIVE IMPLEMENTATION OF THE ACT AND THE REGISTRY), 6 (REGULATION RESPECTING THE PROGRESSIVE IMPLEMENTATION OF THE ACT AND THE REGISTRY), 4 (REGULATION RESPECTING THE PROGRESSIVE IMPLEMENTATION OF THE ACT AND THE REGISTRY), 5 (REGULATION RESPECTING THE PROGRESSIVE IMPLEMENTATION OF THE ACT AND THE REGISTRY) of this regulation are repealed upon completion of mandatory regional deployment.

Sections 8 (REGULATION RESPECTING THE PROGRESSIVE IMPLEMENTATION OF THE ACT AND THE REGISTRY), 2 (REGULATION RESPECTING THE PROGRESSIVE IMPLEMENTATION OF THE ACT AND THE REGISTRY) and 10 (REGULATION RESPECTING THE PROGRESSIVE IMPLEMENTATION OF THE ACT AND THE REGISTRY) are repealed at the same time.

The repeal has no retroactive effect and does not erase any file, vested right, payment or earlier act lawfully established.

Your browsing.

A consultation website without advertising.

A consultation website

Public explanatory pages and proposed legal texts can be read without an account. The consultation is not the future central fire-safety registry. No advertising tracker is added.

Accounts and contributions

The database stores your email, public display name, password hash, sponsorship history, comments, voting identifiers, moderation decisions and security audit events. Your email is not displayed publicly. The president and authorized administrators have role-limited access.

Public comments and archives

Published contributions, their public display names and their approved revisions may be consulted and used in an OPSI consultation brief. A comment refers to a precise version of a proposed section. Non-public drafts and sponsorship email addresses are not part of public archives. The participation FAQ explains moderation, retention and requests for correction or withdrawal.

Aggregate audience counts without consent

The public consultation server counts requests by public page, UTC day and hour, successful OPSI document downloads, and selected feature activations, even if you decline optional cookies. The MySQL counters contain no IP address, browser identifier, fingerprint, browsing history, full URL or personally identifiable event record. Counts are requests or actions, not unique visitors or completed reading. Aggregate counts are kept for trend analysis without a defined automatic expiry.

Optional audience statistics

Only if you actively agree, OPSI also uses a signed pseudonymous browser cookie for session and page history, estimated active time, coarse browser/device/OS information, campaign source, referral domain, time-zone offset, approximate viewport dimensions, scrolling and game/feature-use events (never answers or typed text). No IP address or complete user-agent string is kept in these optional statistical records. The data are accessible only to the president and kept for 395 days by default (the hosting retention value may differ). Withdrawal stops tracking immediately and requests deletion of the associated browser history. A browser does not prove a unique person.

Technical and security logs

The host, web server and security services may separately process IP addresses to protect the infrastructure, prevent abuse and investigate incidents when demonstrably necessary. Such technical records are not joined to audience statistics or used to reconstruct the journeys of people who refuse tracking. Their actual fields, authorized access, retention and deletion schedule, as well as Apache/proxy logs and backups, must be verified and documented with the hosting provider before launch; PHP cannot control their expiry.

Cookies and local progress

Sign-in uses a secure session cookie. A signed browser identifier limits repeated votes, without proving a unique person. With your separate optional agreement, the site can save learning progress and the history of questions you submit on your device (up to one year). Without agreement, learning and question history remain only in the current page memory; the games still work. Theme changes and game scores use local preferences. Technical rate-limit records are periodically purged. You can change or withdraw optional choices from the footer.

Email

Verification, sponsorship and account-recovery messages use the server-configured transport. When Microsoft Graph is enabled, necessary delivery information is sent to that service. Delivery is not guaranteed merely because the service accepted a message.

Retention and your requests

Legislative archives and contribution history are retained for consultation traceability; withdrawal normally hides a comment without erasing its history. Exceptional redaction is separately controlled and logged. Contact info@opsi.info (privacy officer contact for this project, subject to confirmation of the designated person) for access, correction, withdrawal or retention questions. Pseudonymized records remain personal information; counters created without identifiers must not be misrepresented as anonymization of existing personal data. The operator must validate the legal grounds and retention schedules. This implementation is not a legal compliance certificate.
