Notre position

Our analysis
of the proposal.

Expedited cross-party adoption · not enacted

Immediate professional oversight, later infrastructure.

The proposal now separates establishment and professional oversight from development and documentary rollout. Transitional funding is a regulatory proposal subject to legal review; potential savings in document searches and administrative time are not presented as measured outcomes.

Expedited, cross-party legislative adoption is an objective, not evidence of effectiveness or financial validation: assessment of the regulatory model, costs and risks must remain independent.

wet pipedry pipepreaction systemsdelugepumpsbasins / tanksstandpipesdetectionalarmauxiliary functionssmoke controlspecial systemsintegrated testingPDSI

Proposed disciplinary harmonization — a principle to be adapted by legislative counsel: a professional belonging to another order remains subject to that order’s oversight and disciplinary jurisdiction, but the necessary legislative changes must allow an unjustified filing failure to be examined under that regime. This proposal is not final statutory wording.

  • délimiter précisément les actes dont l’encadrement professionnel ajoute une protection utile;
  • valider les interfaces avec l’OIQ, l’OTPQ, la RBQ, la CCQ et les autorités municipales;
  • finaliser les voies d’admission et la transition des praticiens actuels;
  • déterminer la taille réaliste de l’effectif et les coûts d’exploitation;
  • constituer une gouvernance réelle de l’OSBL préparatoire et conduire les consultations;
In summary

Our position

Our analysis
of the proposal.

Why a distinct order is the preferred model, why one permit can coexist with specialized competence, and under what circumstances a subsidiary solution might need to be examined.

Starting point

The objective is not to replace what already works.

OPSI is looking for personal accountability where equivalent protection does not already exist.

Québec already has RBQ, CCQ, municipal authorities, codes and standards, licences, trade qualifications, certifications and professional orders. The mapping exercise must therefore determine, act by act, whether a current mechanism already protects the public adequately.

If an act is already adequately covered by an existing profession or mechanism, the OPSI proposal should be revised rather than creating artificial overlap.
Why not an existing order?

A last-resort solution must remain possible,
without becoming the preferred model.

OTPQ may be examined as a subsidiary institutional solution if creating a distinct order becomes impracticable. It is not, however, considered by OPSI to be the natural institutional home of the proposed profession. OIQ remains relevant where an act legally belongs to engineering.

Proposed OPSI orderFor institutional review●●●●●●●●●●●●●●●●

Cautious reading: this matrix compares institutional functions, not the overall “quality” of organizations. An empty circle does not mean an organization fails to protect the public; it means the compared mechanism is not its general role or is not comparable to a professional order.

OIQ

The normal access pathway is based on university engineering education and a professional-access program designed for future engineers. OPSI activities that are not acts of engineering should not be artificially transformed into engineering merely to obtain professional oversight.

OTPQ

OTPQ is an institutional avenue that could be examined as a last resort, but OPSI does not consider it the natural institutional home of the proposed field. Although some activities overlap, the practice environments, bodies of knowledge and professional pathways are substantially different. Current admission is mainly based on a recognized technology DEC or, for some candidates, academic training equivalent to roughly three years of college-level education, whereas many contemplated OPSI pathways rely on different routes: DVS 5312, trade 416 qualification, fire-alarm pathways, DVS 5295/5296, CCQ qualifications and recognized experience. Integration would likely require a specialized admission, recognition and inspection regime as well as specialized registry infrastructure.

Institutional conclusion: OPSI favours a single institutional structure: a distinct professional order that itself administers the central registry as a permanent function for continuity and traceability of professional acts. A significant, possibly majority, share of filings would be expected to come from members of that order; this assumption must still be confirmed through activity mapping and consultations. Integration into an existing order would be only a last-resort solution if creating the distinct order proved genuinely impracticable and comparable public protection could nevertheless be guaranteed. This position must be examined with the Office and the orders concerned.

Single permit

One common permit does not mean
universal competence.

The single-permit model is also practical: the sub-specialties are too numerous and too intertwined to become stable permit categories.

A preaction-system specialist may need strong knowledge of both water-based suppression and the detection, releasing and alarm functions that control the system, while not necessarily possessing the competence required for fire-water basins, tanks or fire pumps.

Conversely, a specialist in smoke and other combustion-product detection may understand detection in great depth without having the same detailed command of every auxiliary function triggered by a fire-alarm system or of the equipment those functions control. Two professionals holding the same permit may therefore have very different competency profiles.

wetdrypreactiondelugepumpsbasins / tanksstandpipesdetectionalarmauxiliary functionssmoke controlspecial systemsintegrated testingfire safety plans

Permit categories would then also be needed for the many combinations among those areas. The taxonomy would quickly become artificial, burdensome to administer and vulnerable to technological change. The proposal therefore favours an approach comparable to engineering: one professional permit, while each member remains personally responsible for limiting practice to mandates for which they actually possess the necessary knowledge, experience and competence.

The permit defines the profession; it does not define a universal list of specialties mastered. The comparison with engineering concerns this competency model only and grants no act reserved to engineers.
Hierarchy and independence

Professional accountability does not abolish supervision.

Employers retain organizational authority and quality-control functions.

An employer or supervisor may give administrative or organizational directions, supervise work, request verification or rework, request professional review and, if personally authorized and competent, express a different professional conclusion. Professional independence means that each member remains personally responsible for the acts, opinions and conclusions they make or endorse.

A supervisor may require work to be reviewed; they may not force a member to sign or present as their own a professional conclusion the member does not share.
Registry and continuity

The second mechanism acts on information.

The order follows the person; the registry follows selected acts and their history.

The proposed registry would link certain acts to the professional and building, preserve history when stakeholders change and serve as the channel for reports required by the regime. It could also generate anonymized statistics and provide a documented API to already authorized organizations without expanding access rights.

This architecture transfers no municipal power to the Order and replaces neither inspection nor the judgment of a competent authority. Its purpose is continuity and traceability.

What remains to be decided

A structured proposal,
not an institutional conclusion.

Several questions still require testing with affected stakeholders.

  • precisely identify the acts where professional oversight adds useful protection;
  • validate interfaces with OIQ, OTPQ, RBQ, CCQ and municipal authorities;
  • finalize admission pathways and transition for current practitioners;
  • determine realistic membership and operating costs;
  • establish actual governance for the preparatory nonprofit and conduct consultations;
  • subject the registry, access model, cybersecurity and privacy impacts to formal review.
In summary

Why does OPSI propose a distinct order?

Because the project identifies a population coming from several technical pathways and acts for which personal professional accountability may add protection that sector mechanisms do not all provide across the board.

This direction must be demonstrated and refined through mapping and consultations. OPSI nevertheless treats a distinct order and its specialized registry as the preferred model; integration into an existing order remains an exceptional, subsidiary option to be considered only if that model cannot reasonably be implemented.

A consultation website

Public explanatory pages and proposed legal texts can be read without an account. The consultation is not the future central fire-safety registry. No advertising tracker is added.

Accounts and contributions

The database stores your email, public display name, password hash, sponsorship history, comments, voting identifiers, moderation decisions and security audit events. Your email is not displayed publicly. The president and authorized administrators have role-limited access.

Public comments and archives

Published contributions, their public display names and their approved revisions may be consulted and used in an OPSI consultation brief. A comment refers to a precise version of a proposed section. Non-public drafts and sponsorship email addresses are not part of public archives. The participation FAQ explains moderation, retention and requests for correction or withdrawal.

Aggregate audience counts without consent

The public consultation server counts requests by public page, UTC day and hour, successful OPSI document downloads, and selected feature activations, even if you decline optional cookies. The MySQL counters contain no IP address, browser identifier, fingerprint, browsing history, full URL or personally identifiable event record. Counts are requests or actions, not unique visitors or completed reading. Aggregate counts are kept for trend analysis without a defined automatic expiry.

Optional audience statistics

Only if you actively agree, OPSI also uses a signed pseudonymous browser cookie for session and page history, estimated active time, coarse browser/device/OS information, campaign source, referral domain, time-zone offset, approximate viewport dimensions, scrolling and game/feature-use events (never answers or typed text). No IP address or complete user-agent string is kept in these optional statistical records. The data are accessible only to the president and kept for 395 days by default (the hosting retention value may differ). Withdrawal stops tracking immediately and requests deletion of the associated browser history. A browser does not prove a unique person.

Technical and security logs

The host, web server and security services may separately process IP addresses to protect the infrastructure, prevent abuse and investigate incidents when demonstrably necessary. Such technical records are not joined to audience statistics or used to reconstruct the journeys of people who refuse tracking. Their actual fields, authorized access, retention and deletion schedule, as well as Apache/proxy logs and backups, must be verified and documented with the hosting provider before launch; PHP cannot control their expiry.

Cookies and local progress

Sign-in uses a secure session cookie. A signed browser identifier limits repeated votes, without proving a unique person. With your separate optional agreement, the site can save learning progress and the history of questions you submit on your device (up to one year). Without agreement, learning and question history remain only in the current page memory; the games still work. Theme changes and game scores use local preferences. Technical rate-limit records are periodically purged. You can change or withdraw optional choices from the footer.

Email

Verification, sponsorship and account-recovery messages use the server-configured transport. When Microsoft Graph is enabled, necessary delivery information is sent to that service. Delivery is not guaranteed merely because the service accepted a message.

Retention and your requests

Legislative archives and contribution history are retained for consultation traceability; withdrawal normally hides a comment without erasing its history. Exceptional redaction is separately controlled and logged. Contact info@opsi.info (privacy officer contact for this project, subject to confirmation of the designated person) for access, correction, withdrawal or retention questions. Pseudonymized records remain personal information; counters created without identifiers must not be misrepresented as anonymization of existing personal data. The operator must validate the legal grounds and retention schedules. This implementation is not a legal compliance certificate.
