Why the professional system?

Why professional oversight?

The risk already exists. The question is how to oversee it better.

The risk matrix presents the consequences that may result from certain errors or omissions in the activities covered by the proposal. This page addresses a different question: what would the professional system concretely add to the mechanisms that already exist?

A professional order would not make its members infallible. It would, however, add permanent mechanisms for competence, continuing education, professional inspection, ethics and discipline that follow the individual throughout their practice.

View the risk matrix Why the professional system?

La compétence, clé de la confiance du public.Competence, the key to public trust.

Expedited cross-party adoption · not enacted

Public protection begins with professional oversight.

Establishing the Order would permit the roll, competency standards, ethics, professional inspection and discipline independently of the documentary platform. The registry’s activation is not a prerequisite for the rationale for oversight.

OPSI seeks expedited, cross-party legislative adoption in the interest of public protection; this objective does not replace proof of need, stakeholder consultation or review by the Office des professions.

What exists today

Fire safety is already regulated.
The question is professional oversight of the individual signer.

The OPSI proposal recognizes the powers of authorities, requirements applicable to buildings, oversight of businesses, and qualifications or certifications already present in the field.

OPSI analysis

No single cross-cutting professional regime currently covers all individuals who perform the targeted acts and sign the resulting reports.

This position concerns the absence of a cross-cutting professional regime applicable to the individual performing the targeted activities and signing the report. It does not deny the powers of the RBQ and competent authorities, trade qualifications, or professional oversight already applicable when an act is performed by a member of an existing professional order.

What exists
What none of these mechanisms alone brings together for all signers
RBQ — business and construction work
Contractor licences, maintenance conditions and oversight of work governed by the Building Act.
A cross-cutting professional regime combining individual admission to the profession, a personal duty of competence, profession-specific continuing education, professional inspection, ethical duties enforceable despite employer pressure, a syndic, discipline and measures that follow the person from one employer to another.
Competent authorities
Application of requirements within their powers concerning the building, occupancy, systems or fire-safety measures.
By virtue of those powers alone, they do not perform the role of a professional order over each individual who performs and signs the targeted technical activities.
Trade 416 qualification, where applicable
Professional qualification of the fire-protection mechanic under the framework applicable to that trade.
On its own, it does not constitute the cross-cutting professional regime proposed for all targeted activities, including ethics, professional inspection, syndic, discipline and mandatory reporting under the proposal.
Private or sector certifications
Certifications may recognize specific knowledge or skills under their own frameworks.
On their own, they do not constitute a Québec professional order with the mechanisms provided by the Professional Code.

What the order would add

The order does not promise the absence of error.
It organizes the prevention, detection and correction of professional errors.

The professional system adds permanent mechanisms that apply directly to the individual, their competence and their practice.

01

Admission

A common threshold must be met before obtaining the right to perform reserved activities.

02

Personal competence

A member must refuse or limit a mandate when they do not have the necessary knowledge, experience or means.

03

Continuing education

Competence must be maintained as codes, standards, technologies and practices evolve.

04

Professional inspection

The Order can examine its members’ practice and detect inadequate methods even when no complaint has yet been filed.

05

Ethics and independence

Professional obligations belong personally to the member and do not disappear at the request of a client or employer. This independence does not abolish the reporting relationship: the employer may organize and supervise the work, request checks or rework, and arrange for professional review; if the employer is also authorized and competent, they may perform that review or express their own conclusion. However, the employer may not require the member to sign or endorse a professional conclusion with which the member disagrees.

06

Syndic and discipline

When misconduct is alleged or identified, independent investigation and disciplinary mechanisms are available.

07

Continuity

Oversight follows the individual.

A change of employer, provider or employment status does not reset the clock.
Advance fees protected. Where a member requires an advance for professional services, the proposal provides that it remains in a general trust account until the corresponding services are actually rendered and invoiced. Separate accounting must be maintained for each client, every unearned amount must be refunded, and the regime must include an indemnification mechanism in accordance with sections 89 and 89.1 of the Professional Code. No special trust account is provided for.
Why a separate order?

A proposal aligned
with the proposed field.

OPSI currently proposes a separate order. Three considerations explain this working direction.

01

A coherent professional field

The proposed activities share the assessment of fire-safety functions, the production of professional conclusions and the protection of occupants, even though they involve several families of systems.

02

Distinct competence pathways

Practitioners may come from trades, technical training, specialized certifications and different forms of experience. The admission and recognition-of-prior-learning regime must be designed for this reality.

03

Mechanisms specific to the proposal

The central registry, traceability of professional acts, and the classification and follow-up regime for reporting-exempt non-compliances and non-compliances under documented action and non-compliances requiring action are closely tied to the proposed field and require coherent organization.

The creation of a distinct professional order is OPSI’s preferred model. Consultations should primarily clarify overlap with existing orders, confirm the limits of the proposed field and verify that this architecture can be implemented proportionately.

A subsidiary solution remains possible

OPSI clearly favours creating a distinct professional order that itself administers the central registry as a permanent function. Integration into an existing order would be considered only exceptionally and as a last resort if that natural solution proved genuinely impracticable despite a demonstrated need for professional oversight, and only if comparable public protection could be achieved.

Work to continue

What remains
to validate.

The initiative will notably need to clarify:

  • the number and backgrounds of the practitioners concerned;
  • the exact overlaps with existing professional and regulatory regimes;
  • admission and transition conditions;
  • the financial viability of the model and its effects on service availability.

These elements will be addressed through consultations and preparatory work for a possible formal submission to the Office des professions.

Your browsing.

A consultation website without advertising.

A consultation website

Public explanatory pages and proposed legal texts can be read without an account. The consultation is not the future central fire-safety registry. No advertising tracker is added.

Accounts and contributions

The database stores your email, public display name, password hash, sponsorship history, comments, voting identifiers, moderation decisions and security audit events. Your email is not displayed publicly. The president and authorized administrators have role-limited access.

Public comments and archives

Published contributions, their public display names and their approved revisions may be consulted and used in an OPSI consultation brief. A comment refers to a precise version of a proposed section. Non-public drafts and sponsorship email addresses are not part of public archives. The participation FAQ explains moderation, retention and requests for correction or withdrawal.

Aggregate audience counts without consent

The public consultation server counts requests by public page, UTC day and hour, successful OPSI document downloads, and selected feature activations, even if you decline optional cookies. The MySQL counters contain no IP address, browser identifier, fingerprint, browsing history, full URL or personally identifiable event record. Counts are requests or actions, not unique visitors or completed reading. Aggregate counts are kept for trend analysis without a defined automatic expiry.

Optional audience statistics

Only if you actively agree, OPSI also uses a signed pseudonymous browser cookie for session and page history, estimated active time, coarse browser/device/OS information, campaign source, referral domain, time-zone offset, approximate viewport dimensions, scrolling and game/feature-use events (never answers or typed text). No IP address or complete user-agent string is kept in these optional statistical records. The data are accessible only to the president and kept for 395 days by default (the hosting retention value may differ). Withdrawal stops tracking immediately and requests deletion of the associated browser history. A browser does not prove a unique person.

Technical and security logs

The host, web server and security services may separately process IP addresses to protect the infrastructure, prevent abuse and investigate incidents when demonstrably necessary. Such technical records are not joined to audience statistics or used to reconstruct the journeys of people who refuse tracking. Their actual fields, authorized access, retention and deletion schedule, as well as Apache/proxy logs and backups, must be verified and documented with the hosting provider before launch; PHP cannot control their expiry.

Cookies and local progress

Sign-in uses a secure session cookie. A signed browser identifier limits repeated votes, without proving a unique person. With your separate optional agreement, the site can save learning progress and the history of questions you submit on your device (up to one year). Without agreement, learning and question history remain only in the current page memory; the games still work. Theme changes and game scores use local preferences. Technical rate-limit records are periodically purged. You can change or withdraw optional choices from the footer.

Email

Verification, sponsorship and account-recovery messages use the server-configured transport. When Microsoft Graph is enabled, necessary delivery information is sent to that service. Delivery is not guaranteed merely because the service accepted a message.

Retention and your requests

Legislative archives and contribution history are retained for consultation traceability; withdrawal normally hides a comment without erasing its history. Exceptional redaction is separately controlled and logged. Contact info@opsi.info (privacy officer contact for this project, subject to confirmation of the designated person) for access, correction, withdrawal or retention questions. Pseudonymized records remain personal information; counters created without identifiers must not be misrepresented as anonymization of existing personal data. The operator must validate the legal grounds and retention schedules. This implementation is not a legal compliance certificate.
